Website: www.horseconversations.com
– hereinafter referred to as “Horse Conversations” or the “Provider” –
and its customers regarding the services and products offered by Horse Conversations.
These include in particular:
horse behaviour consultations,
online consultations and video calls,
in-person consultations and training,
coaching and mentoring,
workshops, seminars and events,
clicker training and other training services,
professional education and services for equine businesses,
online courses,
digital products,
PDFs, e-books, worksheets and training materials,
video, audio and other digital content,
individually prepared assessments, training plans and recommendations.
Any deviating agreements apply only if expressly agreed between Horse Conversations and the customer.
These Terms apply both to consumers within the meaning of Section 13 of the German Civil Code (BGB) and to entrepreneurs within the meaning of Section 14 BGB. Where individual provisions apply only to one of these groups, this is expressly stated.
2. Conclusion of Contract
The presentation of services and products on the website, on social media or in other media does not constitute a legally binding offer unless expressly stated otherwise.
A contract is concluded in particular through:
a binding booking made via the booking or payment system used on the website,
an individual booking confirmation by email or message,
acceptance of an individual offer,
or another express agreement between Horse Conversations and the customer.
The specific scope of the service is determined by the respective service description, booking confirmation or individual agreement.
3. Subject Matter of the Services
Horse Conversations provides professional consultation, training, coaching and educational services in the areas of horse behaviour, ethology, communication, management and training.
The specific content and scope of each service are determined by the respective offer booked.
For consultation and training services, Horse Conversations owes the agreed professional service, but not a specific result.
In particular, Horse Conversations cannot guarantee that:
a specific behaviour of a horse will change within a certain period,
a particular training goal will be achieved,
behavioural problems will completely disappear,
a particular physical or health-related development will occur,
or a specific development in the relationship between human and horse will be achieved.
Behaviour and learning are influenced by numerous factors outside the control of Horse Conversations.
4. No Veterinary or Therapeutic Treatment
The services provided by Horse Conversations do not replace veterinary diagnosis or treatment.
Where there are signs of pain, illness or other health-related problems, a veterinarian or other appropriately qualified professional should be consulted.
Horse Conversations may recommend that potential veterinary, dental, physiotherapeutic, osteopathic, saddle-related, hoof-related or other physical causes be professionally assessed before or during behavioural consultation.
Horse Conversations does not provide veterinary diagnoses and does not make promises of healing or recovery.
5. Coaching and Personal Matters
Where personal issues are discussed in the course of a consultation or coaching session, such services do not constitute psychotherapy or medical or psychological treatment.
Coaching does not replace psychotherapy, psychiatric treatment or medical care.
6. Customer Cooperation Obligations
Effective consultation requires the customer to provide relevant information as completely and truthfully as possible.
This may include in particular:
the horse’s history,
management and feeding,
training history,
known illnesses or pain,
current veterinary findings,
observed behaviour,
photos or video material,
previous training measures.
Horse Conversations is not responsible for incorrect assessments resulting from relevant information being withheld, provided incompletely or incorrectly.
The customer remains responsible at all times for decisions regarding the horse’s management, training, handling, medical care and general welfare.
7. Safety and Handling of Horses
Working with horses inherently involves risks.
Customers are responsible for taking appropriate account of their own safety, the safety of other persons and the welfare of the horse.
Recommendations by Horse Conversations must always be implemented with regard to:
the specific situation,
the skills and experience of the persons involved,
the horse,
the environment,
and any known physical or health limitations.
A recommendation should not be carried out where the customer knows or reasonably ought to know that it could create an unsafe situation.
For in-person appointments, Horse Conversations may modify or stop an exercise or appointment where this appears necessary for animal welfare or safety reasons.
8. Animal Welfare and Training Principles
Horse Conversations works according to horse-friendly and behaviourally informed principles.
Horse Conversations is not obliged to carry out or recommend methods that, in its professional assessment, involve:
unnecessary pain,
significant stress,
fear,
intimidation,
violence,
practices contrary to animal welfare,
or avoidable risks to the horse or persons involved.
Horse Conversations may refuse or discontinue cooperation where methods are requested or used that are incompatible with its professional or ethical principles.
Mandatory statutory rights of the parties remain unaffected.
9. Appointments
Consultations and coaching sessions take place at individually agreed times.
For online appointments, the customer is responsible for ensuring timely access to:
a suitable device,
a sufficient internet connection,
a camera and, where necessary, a microphone.
Technical problems within the customer’s area of responsibility generally do not entitle the customer to an extension of the agreed appointment.
If Horse Conversations is unable to provide an appointment for an important reason, an alternative appointment will be offered.
If no suitable replacement appointment can be agreed, payments already made for the service not provided will be refunded.
10. Cancellation and Rescheduling of Appointments
Individual appointments are reserved on a binding basis.
Cancellation or rescheduling is free of charge up to 48 hours before the agreed appointment.
For later cancellations, Horse Conversations may claim reasonable compensation for the reserved appointment where it could not be allocated to another customer.
For cancellations made less than 24 hours before the appointment or in the event of a no-show, Horse Conversations may generally claim the agreed remuneration, less expenses saved and any income obtained by allocating the appointment elsewhere.
The customer expressly remains entitled to demonstrate that no loss or a substantially lower loss was incurred.
If the appointment can be allocated to another customer, this will be taken into account.
Any statutory right of withdrawal remains unaffected.
11. Late Arrival
If the customer arrives late, there is generally no entitlement to an extension of the agreed appointment.
Any extension is at the discretion of Horse Conversations and depends on whether subsequent appointments would be affected.
12. In-Person Appointments and Travel Costs
Additional travel or transportation costs may apply to consultations, training sessions, workshops or other services provided on location.
The applicable costs will be communicated before conclusion of the contract or agreed individually.
For longer journeys, accommodation, travel or other necessary expenses may also be charged where this has been agreed in advance.
13. Prices and Payment
The prices stated at the time of booking or individually agreed apply.
All prices are shown in accordance with the applicable VAT treatment.
Payment is due in accordance with the payment terms communicated at the time of booking.
For online bookings, payment may be required immediately at the time of booking.
Horse Conversations may require advance payment for individually agreed services where this is communicated before conclusion of the contract.

Digital products may include in particular:
PDFs,
e-books,
workbooks,
training plans,
videos,
audio content,
online courses,
recorded workshops,

The exact scope of the product is determined by the respective product description.

All rights not expressly granted remain with Horse Conversations or the respective copyright holder.
16. Personal Licence to Use Materials
By purchasing or receiving materials, the customer receives, unless expressly agreed otherwise, only the right to use them for their own personal purposes.
The licence does not include the right to reproduce, distribute or otherwise use the content, in whole or in substantial part, in particular by:
passing it on to other persons,
reproducing and distributing it,
uploading it publicly,
sharing it through cloud folders or download links,
distributing it via messenger services, email or social media,
publishing it on websites or social media profiles,
presenting it as the customer’s own work,
commercially exploiting it,
reselling it,
using it in the customer’s own courses, consultations, workshops or training programmes,
translating and distributing the translation,
modifying and distributing the modified version,
redistributing it under another name,
or making it available to third parties for commercial use,
unless such use is mandatory under applicable law or has been expressly authorised in writing in advance.
17. Use by Trainers, Coaches and Other Professionals
Purchasing a product or participating in professional training does not automatically entitle trainers, coaches or other professionals to reproduce the materials received for their own clients or use them in their own courses, workshops, training programmes or commercial services.
This applies in particular to:
handouts,
worksheets,
graphics,
illustrations,
training plans,
course slides,
teaching materials,
video and audio content.
Where materials from Horse Conversations are to be used professionally, commercially or for teaching purposes, a separate licence agreement is required.
18. No Sharing of Access Credentials
Personal access to online courses, member areas, video libraries or other digital services may not be shared with other persons.
Access is provided exclusively to the person who purchased the service unless a team, business or multi-user licence has expressly been agreed.
Horse Conversations may temporarily suspend access where there are specific indications that login details have been shared without authorisation or that content is being systematically reproduced.
Before permanent suspension, the circumstances will be appropriately reviewed. Mandatory statutory rights remain unaffected.
19. Recording of Consultations, Courses and Events
Audio, video, screen or other recordings of consultations, online calls, courses, workshops, presentations or other events provided by Horse Conversations are not permitted without prior express consent.
This includes in particular:
screen recordings,
audio recordings,
comprehensive photographs of presentations or course materials,
recordings of video conferences,
recordings of online courses or live sessions.
Uses permitted by mandatory law remain unaffected.
20. Use in Artificial Intelligence and Automated Systems
Non-public or paid materials provided by Horse Conversations may not, without prior express permission, be reproduced in full or in substantial part by:
uploading them into generative AI systems,
using them to train or fine-tune AI models,
incorporating them into datasets,
extracting them through automated means,
systematically scraping them,
or using them to create competing or derivative commercial content,
unless such use is expressly permitted by mandatory applicable law.
This applies in particular to books, course materials, workbooks, illustrations, training concepts and internal educational materials.
21. Quotations and Attribution
Merely naming “Horse Conversations” or Carolina Baurmann as a source does not in itself create permission to copy or republish copyrighted content.
Legally permitted quotations remain possible.
Any further reproduction, publication or use requires prior permission from the copyright holder.
22. Individual Training Plans and Assessments
Individually created training plans, analyses, written assessments and similar documents are prepared for the respective customer and the specific horse discussed.
They may be used for personal work with that horse and, where necessary, may be shared with professionals directly involved in the horse’s care, such as veterinarians, therapists or trainers.
Publication, commercial use or use as a template for the customer’s own consulting, training or educational services is not permitted without separate authorisation.
23. Infringement of Rights
In the event of unauthorised use of copyrighted content, Horse Conversations reserves the right to assert all claims available under applicable law.
These may include claims for:
removal,
injunctive relief,
information,
and, where applicable, damages.
The amount of any damages is determined in accordance with applicable law and the circumstances of the individual case.
24. Liability
Horse Conversations is liable without limitation:
in cases of intent and gross negligence,
for damage arising from injury to life, body or health,
and in cases of mandatory statutory liability.
In the case of slight negligence involving the breach of an essential contractual obligation, liability is limited, where legally permissible, to the typical and foreseeable damage.
In all other cases, liability for damage caused by slight negligence is excluded to the extent permitted by law.
Mandatory statutory rights of consumers remain unaffected.
25. Behaviour and Reactions of the Horse
Horse Conversations cannot accept liability for the independent reactions or behaviour of a horse unless damage results from a culpable breach of duty by Horse Conversations.
Horses are living animals with independent behaviour. Unexpected reactions may occur even where training is carried out professionally and appropriately.
General statutory liability rules remain unaffected.
26. Right of Withdrawal for Consumers
Consumers may have a statutory right of withdrawal in relation to distance contracts.
Information concerning the existence, requirements, time limits and consequences of the right of withdrawal is provided in a separate Withdrawal Policy.
These Terms and Conditions do not replace the legally required Withdrawal Policy.
27. Start of Services During the Withdrawal Period
Where a consumer expressly requests that a booked service begin before expiry of the statutory withdrawal period, Horse Conversations may begin providing the service during that period in accordance with the applicable legal requirements.
Any express declaration required for this purpose will be obtained separately.
28. Digital Content and the Right of Withdrawal
For paid digital content not supplied on a tangible medium, the statutory right of withdrawal may expire under the applicable legal conditions once performance of the contract has begun.
Where required, before access to the digital content is provided, the customer will expressly:
consent to performance beginning before expiry of the withdrawal period, and
acknowledge that the right of withdrawal will be lost as a result.
29. Cancellation of Workshops, Courses and Events by Horse Conversations
Horse Conversations may cancel or postpone events for an important reason, for example illness, force majeure or failure to reach a required minimum number of participants.
If an event is cancelled completely, participation fees already paid for the affected event will be refunded.
Any further claims exist only in accordance with the applicable statutory liability provisions.
30. Changes to the Scope of Services
Minor changes to the structure or content of a course, workshop or programme are permitted provided that they do not materially change the nature or essential purpose of the agreed service.
Changes to individual elements must not result in an unreasonable reduction of the agreed overall service.
31. Communication and Submitted Content
Customers may send Horse Conversations videos, photographs and information concerning their horse as part of a consultation.
The customer confirms that they are entitled to provide such material and that doing so does not infringe the rights of third parties.
Photographs, videos or other material submitted by customers are not automatically used for advertising, social media, educational materials or other public purposes.
Such use will take place only where the necessary permission or consent has been obtained.
32. Confidentiality
Horse Conversations treats personal information disclosed during individual consultations or coaching sessions as confidential.
Statutory disclosure obligations and technically necessary processing by service providers remain unaffected.
Further information on the processing of personal data is contained in the Privacy Policy.
33. Consumer Dispute Resolution
Horse Conversations is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless a statutory obligation to participate applies.
34. Applicable Law
The law of the Federal Republic of Germany applies.
For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the country in which they have their habitual residence.
35. Jurisdiction for Business Customers
Where the contractual partner is a merchant, legal entity under public law or special fund under public law, the registered office of Horse Conversations may be agreed as the place of jurisdiction to the extent permitted by law.
For consumers, the statutory rules on jurisdiction apply.
36. Final Provisions
Individual agreements between Horse Conversations and the customer take precedence over these General Terms and Conditions.
If an individual provision of these Terms is or becomes invalid, the legal consequences are governed by the applicable statutory provisions.
